How Are Escape Charges Prosecuted?
To prove the crime of Escape, the State Attorney must prove the following three elements beyond a reasonable doubt:
- The person charged was [under arrest and in the lawful custody of a law enforcement official] or [convicted of a crime and sentenced to a term of imprisonment and committed to a penal institution by a court].
- While a prisoner, the person charged was [confined at a penal institution] or [being transported to or from a place of confinement] or [working on a public road].
- The person charged escaped or attempted to escape, intending to avoid lawful confinement.
