What to do if falsely accused

On Behalf of | Oct 8, 2023 | Criminal Defense

Living in Florida, your reputation and freedom are important to you. And few things are as traumatic and damaging as being falsely accused of a serious crime. Even if you’re innocent of whatever is being alleged, the consequences to your life can be severe.

While in a perfect world, your innocence would always be enough to see justice done, the reality is that even innocent people can face punishment for crimes they didn’t commit. And even if acquitted, your reputation can take a major hit if you don’t take certain precautions after being accused of a crime.

Understand the seriousness of the situation

There might be a temptation to not take a false accusation seriously. After all, you didn’t do what someone is claiming you did. It shouldn’t be your problem.

But unfortunately, a false accusation can still lead to a charge that requires a criminal defense and can even result in an unjust conviction. As such, it’s important that you take this situation extremely seriously.

That means taking all steps toward your legal defense. If there’s any evidence that exonerates you — documents, texts, calls, cellphone location data, testimony from witnesses backing up your story or anything else — make all possible efforts to gather that evidence. This can result in the state dropping charges against you.

Be careful of what you say

People falsely accused of a crime often make two major mistakes. The first is speaking to the police without representation present. And the second is having contact with the accuser.

As an innocent person, you might think talking to the police can’t harm you. But this couldn’t be further from the truth. Statements you make in all innocence to the police can come back to harm you in court.

And speaking with your accuser can lead to confrontation, as emotions will usually be high. It’s possible to end up committing an act that leads to further trouble.

If you’re falsely accused of a crime, you need to be very careful in how you handle the situation. Taking the necessary precautions will ensure your freedom and good reputation.
