Car accidents: man dead in Florida

A man from Felda was involved in a fatal crash north of Immokalee early on March 23, according to local sources. Florida authorities have confirmed the death of the man, who was 46 years old, and the injury of a second person. As with many car accidents, this one is still under investigation, and no charges have been filed so far. 

According to the limited information in the report, it appears the 46-year-old victim was traveling south on State Road 29 when the accident occurred. A northbound vehicle driven by a 50-year-old Immokalee man attempted to make a left-hand turn onto State Road 82, bringing his vehicle into the path of the southbound vehicle. This led to a head-on crash between the two vehicles. 

The older man suffered minor injuries in the crash; he had been wearing a seat belt at the moment of impact. The other man, who was also wearing a seat belt, was rushed to a local hospital with critical injuries. He was pronounced dead some time later. Police say alcohol is not a suspected factor in the crash, but they are still investigating the particulars of the incident. 

If it becomes clear that the older driver acted negligently or recklessly in his operation of a motor vehicle, he could be criminally charged for his role in the other man's death. Even if no criminal charges are filed, Florida state law allows the victims of car accidents and/or their families to file personal injury and wrongful death suits in civil court against the driver responsible. These suits are handled separately from any criminal hearing but can make use of police evidence gathered to support such a claim.
