Swimming Pool Accidents

Most Floridians enjoy swimming pools to escape the searing heat but, unfortunately, swimming pool accidents are a regular occurrence in areas like Naples and Fort Myers. According to the Center for Disease Control, more children under the age of 5 in the state of Florida drown than in any other state.

As the founder of The Caldarone Law Group, P.A., in Naples, I have seen adults and children seriously injured or killed by outdated or malfunctioning pool drain covers and other pool equipment. I am a personal injury attorney who stands ready to help you determine whether someone else's negligence, carelessness or recklessness caused you or a loved one's injuries or death. My firm has handled cases against landlords, property owners, condominium and homeowners associations, caregivers, babysitters, and builders and contractors.

When evaluating a swimming pool accident case, I investigate when the swimming pool was built, because newer pools are required by law to have certain safeguards in place. In 2000, the Florida Legislature passed a law called the Ibern/McKenzie Merriam Residential Swimming Pool Safety Act, which requires new residential pools, hot tubs and spas to have the following:

  • A barrier surrounding the entire pool four feet tall or higher
  • An approved pool cover
  • Entrances that have self-closing and self-locking devices
  • Alarms on every door and window in a home with direct access to a pool
